Owners, contractors, consultants and other parties should establish claim avoidance strategies prior to the onset of the work and maintain such understanding and harmony in the currency of the contract.

    Claim documentation and avoidance strategies should include training of personnel and development of procedures to handle disputes and resolve with all expedition. Claim avoidance strategy tends to prevent dispute from occurrence or unravel them with all haste and at no additional cost to the parties.

    A claim avoidance plan is primarily aimed at preserving Owner-Contractor and stake holders relations and interests and eventually save time, money and efforts of all parties.The ultimate objective of claim avoidance plan is to eliminate /mitigate the occurrence of all potential claims.Owners, contractors, consultants and other parties should establish claim avoidance strategies prior to the onset of the work and maintain such understanding and harmony in the currency of the contract.Contract documents must be complete thoroughly detailed and verified prior to formalization.Contractor’s personnel  must be highly qualified, competent, capable and loyal. Contractor’s understanding for the project requirements must exactly meet the owner’s expectations. Construction works must be precisely performed as planned and to the specified quality.Contract and relationship among the parties shall be predicated on good faith, sincerity, transparency and mutual understanding, respecting the principles of real partnership. An effective and meaningful claim avoidance plan can realize this target through the implementation of well conceived and comprehensive strategies during the following stages: Design Phase (concerned with Employer/Developer)Procurement Tender /Precontract Phase (Both for Employer and Contractor)Construction Phase (Both for Employer and Contractor)Despite all the precautions, there may still be probability for potential claims, but naturally much less.In addition, many claims are not identified until the project is nearing completion, and the parties realizes that it is over budget.Complete and accurate records can quash and forestall many claims or at least facilitate settlement and swift solutions.
